2 Activities and risk acknowledgement
The Academy means the operator identified above. Activities means Academy-provided Brazilian Jiu Jitsu in gi and no gi, grappling, takedowns, drilling, sparring, open mats, conditioning, private lessons, trials, gradings and seminars at the address above, or at another venue notified by the Academy. External competitions and independently organized activities are not covered. I understand that Activities involve falls, throws, joint locks, chokes, pressure, close contact and unpredictable movements. Risks include bruising, cuts, sprains, torn ligaments, dislocations, fractures, dental and eye injuries, concussion, loss of consciousness, neck, spinal and nerve injury, infection, heat illness, aggravation of existing conditions, permanent disability and death. Injury may arise from other participants, instruction, equipment or the training environment. Safety precautions cannot eliminate every risk.
I choose to participate voluntarily, understand these risks and accept the ordinary and inherent risks of the Activities, subject to rights that cannot lawfully be excluded. I may decline a technique or round and stop at any time.
3 Health and safe training
I will disclose relevant injuries, medical conditions, recent concussion, allergies, medications and other limitations privately to the coach before training, and keep that information current. I will obtain medical advice or clearance where appropriate or reasonably requested. Coaches do not provide medical clearance. I will follow coaching instructions and the rules explained to me; tap early; immediately release any hold when a partner taps, submits verbally or appears distressed; use controlled techniques appropriate to the class and partner; and avoid prohibited or reckless conduct. I will stop and notify staff if injured, dizzy, unwell or unsafe. I will not train while impaired by alcohol or drugs, or with a potentially contagious illness or skin condition. I will maintain personal hygiene, clean clothing and trimmed nails, remove jewelry and report hazards promptly.
4 Adult release and consumer law limits
This clause applies only to a participant aged 18 or over signing personally. Protected Persons means the Daisy Hill Jiu Jitsu and its directors, employees, instructors and volunteers, but only while providing the Activities.
Subject to the limits below and only to the extent permitted by law, I release the Protected Persons from liability for death or personal injury arising from my participation in the Activities, including liability caused by their negligence in providing instruction, supervision, facilities or equipment.
Where section 139A of the Competition and Consumer Act 2010 (Cth) applies to the Academy’s supply of recreational services, I agree to exclude the consumer guarantees in Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law, the exercise of rights under those guarantees and liability for failure to comply with them, solely in relation to death or physical or mental injury, including aggravation, acceleration or recurrence of such injury.
These exclusions do not apply to significant personal injury caused by the supplier’s reckless conduct within section 139A, intentional wrongdoing, or any liability or right that cannot lawfully be excluded. Nothing in this agreement excludes non-excludable consumer rights. It does not waive statutory safety duties or exclude consumer guarantees relating to goods or property loss. The Academy does not promise that every part of this release will be enforceable.
5 First aid and emergency assistance
I consent to reasonable first aid. If I cannot give consent, I authorise staff to seek emergency assistance and contact my emergency contact. For a child, I authorize staff to seek urgent assistance if I cannot be reached promptly. Treatment decisions remain with qualified health professionals under applicable law. I accept ambulance and medical costs for which I am legally responsible; this does not remove any right to recover costs from another person. I understand that participation does not itself guarantee personal accident insurance.
6 Privacy
I consent to the Academy collecting and using the health information I provide for safe participation and emergency response, and sharing relevant details with treating professionals when necessary. The Academy will handle personal information under applicable law and its privacy notice, available at [PRIVACY NOTICE URL OR RECEPTION]. For access, correction or privacy questions contact
[email protected].
7 Agreement and signatures
Queensland law governs this agreement. It covers ongoing Activities from signing until replaced, subject to lawful termination; material changes require fresh agreement. Fees and cancellations are dealt with separately. An invalid provision is severed only where legally possible. I have read both pages, had the opportunity to ask questions and sign voluntarily.
